A traumatic brain injury is a very severe injury, but the effects aren’t always immediately visible. A person who has suffered a TBI does not require the care that a broken bone would, and there aren’t any of the physical indications of an injury, but the truth remains that there is significant damage to the body’s control center.
TBI victims can face thousands of dollars in medical costs for various forms of care. Additionally, many victims are unable to return to their former jobs, and some people are permanently incapable of securing any kind of employment.

Do I Need a Brain Injury Lawyer?
You know that your TBI is serious, and your doctor may say the same, but an insurance company is very likely to downplay the severity of your injury. TBI victims do not have the benefit of graphic photos that are common with other kinds of injuries, so there is often a greater need to emphasize other types of medical evidence.
Proving a TBI can be complicated, which is why you will want to work with an attorney who has experience handling these types of injury cases. Caffee Law has helped people who have sustained TBIs in all sorts of accidents.
Insurance companies are always seeking ways to avoid having to pay anything for these claims, and one of the easiest ways to do this is to trick a victim into admitting their negligence in an accident. For this reason, you should never speak to any insurance company without legal representation.
Some insurers will quickly offer people lump-sum settlements to resolve their cases. These offers are almost always far short of what victims are entitled, so you will want to make sure you have a lawyer who can work to help you obtain a fair and full settlement.

Types of Brain Injury Cases We Handle
TBIs are complex injuries that do not always lead to immediate and identifiable symptoms. Some symptoms may be more subtle in some cases.
Physical symptoms of TBIs often include but are not limited to:
- Migraine headaches
- Repeated vomiting or nausea
- Fluids drainage from the nose or ears
- Weakness or numbness in fingers and toes
- Loss of consciousness
- Loss of coordination
- Blurred vision
Mental or cognitive symptoms can also include but are not limited to:
- Short-term memory loss
- Changes in appetite
- Slurred speech
- Profound confusion
Concussions are the most common kind of TBI, but other types can include contusions, which are brain bruises causing bleeding, and coup-contrecoup TBIs, which involve contusions on both sides of the brain. A diffuse axonal TBI involves the tearing of nerve tissue, and some people may suffer penetrating injuries in which external objects enter the brain.
Some of the kinds of accidents that cause TBIs include but are not limited to:
- Workplace accidents
- Slip and fall accidents
- Nursing home abuse
- Defective products
- Construction accidents
- Wrongful death
- Pedestrian accidents
- Bicycle accidents
- Motorcycle accidents
- Truck accidents
- Car accidents
You should know that an insurance company is extremely likely to undervalue your TBI claim, as there is often very little consideration given to the pain, suffering, and confusion a victim is dealing with following their injury. You want to be sure that you have a lawyer who can accurately assess the true value of your claim and work to recover that amount.
Seattle Brain Injury Statistics
The Washington State Department of Health reported that 1,304 Washington residents died from TBIs in 2005. Men 65 years of age and older were identified as being at the highest risk of TBI death, with most deaths in this age group resulting from falls, although motor vehicle crashes and suicide (predominantly with firearms) were the leading causes of TBI deaths for all age groups.
The Brain Injury Association of America reported that TBIs caused an estimated 2,685 deaths, 37,000 hospitalizations, and 435,000 emergency department visits among children 14 years of age or younger, and was responsible for 62,000 hospitalizations and 564,000 emergency department visits among children 19 years of age or younger.
In its December 1999 Report to Congress, the Centers for Disease Control and Prevention reported that 50,000 of the 1.5 million Americans who sustain a TBI die. While 230,000 people who are hospitalized will survive, 80,000 to 90,000 will face the onset of long-term disability. In another Report to Congress five years later, the CDC reported that falls were the leading cause of TBI for children 14 years of age and younger, with the two age groups at highest risk for brain injury being children younger than four years of age and those between 15 and 19 years of age.
The American Association of Neurological Surgeons estimates that 50 to 70 percent of TBI accidents are caused by motor vehicle crashes. Furthermore, 30 percent of the over 55,000 teenage drivers and passengers seriously injured in auto accidents in 2009 and 2010 suffered acute head injuries like TBIs, according to an April 2012 report from the Children’s Hospital of Philadelphia and State Farm Insurance.
